Terms of Use for the Members Portal - Becobra (formerly BVVM/UPCA)

These terms specifically apply to the restricted section of Becobra website (hereinafter the “Members Portal”) and supplement the General Terms of Use of the website.

2. Scope and Acceptance

2.1 By accessing and using the Members Portal, you expressly agree to the General Terms of Use and these additional terms. These terms apply to the current version as well as all future versions, updates, or renewals.

2.2 Becobra reserves the right to amend these terms at any time. Important changes will be communicated via the Members Portal or by email.

2.3 If any provision is found invalid or unenforceable, the remaining provisions remain valid.

3. Access and Registration

3.1 Access is strictly reserved for affiliated insurance brokers (including self-employed persons, SMEs, and brokerage offices) and their authorized employees.

3.2 Each user receives a personal account. Sharing login credentials with third parties who do not have an authorized account, is strictly prohibited.
If the member is a company or office, he is jointly liable for the use by its employees, administrators or representatives.

The company/office is also responsible for immediately informing Becobra and deactivating the account when an employee leaves the organization.

3.3 Users are responsible for password security and must immediately report suspected misuse to Becobra.

4. Use of Documentation and Information

4.1 The Members Portal is a digital archive and knowledge center providing documents (templates, legal analyses, sector guidelines, presentations), videos, and images.

4.2 Members have the right to consult and download published documents for internal professional use within their own office or company

4.3 The Members Portal does not allow any interactive communication, downloading, or modification by members. Only Becobra is authorized to publish information.

4.4 It is prohibited to publicly distribute, sell, or share documents from the Members Portal to non-members or third parties (such as software providers or competing professional organizations) without the express written authorization of Becobra.

4.5 It is also prohibited to use access to the portal to develop services that directly compete with the activities of Becobra.

5. Intellectual Property

5.1 All the published documents, templates, and data remain the exclusive intellectual property of Becobra or its licensors. The structure and selection of the documents are also protected.

5.2 Downloading a document does not imply any transfer of ownership rights, but only a right of use limited to the duration of the membership.

6. Limitation of Liability

6.1 Becobra strives to provide high-quality information. Given the complexity and rapidly evolving nature of legislation in the insurance sector (such as AssurMiFID and anti-money laundering legislation), all information is provided “as is” at the time of publication.

Becobra is subject only to a best-efforts obligation and cannot be held liable for the failure to achieve a specific result, nor for any damages resulting from errors of interpretation or the use of outdated documents. The use of these documents never relieves the broker of his or her own professional, legal, and ethical obligations. The responsibility towards clients and supervisory authorities (such as the FSMA) rests exclusively with the broker.

6.2 Becobra does not guarantee 24/7 availability of the portal and shall not be held liable for technical malfunctions temporarily preventing access to the documents, nor for any damage caused by malicious acts of third parties.

6.3 The Members Portal may contain hyperlinks to third-party websites. Becobra exercises no control over the content or other characteristics of such websites and shall under no circumstances be held liable for their content, operation, or any damages resulting from their use.

6.4 The user and/or the office he or she represents undertakes to indemnify and hold harmless Becobra against any third-party claims (including compensation for damages) arising from the unlawful use, distribution, or disclosure of documents or information from the Portal.

7. Termination of Access

7.1 Access to the Members Portal shall automatically terminate:

  1. Upon termination of the membership of the concerned person or the company he or she represents.
  2. In the event of misuse of login credentials or unlawful distribution of documents.
  3. Upon cessation of professional activities as an insurance broker.
  4. When an employee leaves an affiliated office.

8. Privacy and Cookies

8.1 When visiting the website, registering for events, or creating an account, Becobra collects personal data, which is processed in accordance with the GDPR.

9. Applicable Law and Jurisdiction

9.1 Belgian law shall apply exclusively.

9.2 In the event of a dispute, the parties shall first attempt to resolve the matter amicably. Failing such resolution, only the Dutch-speaking or French-speaking courts of the judicial district of Brussels shall have jurisdiction, unless mandatory legal provisions provide otherwise.

In case of dispute, parties will first seek amicable settlement. If not possible, only the Dutch-speaking or French-speaking courts of the judicial district of Brussels have jurisdiction.
