Tacit renewal: companies will be required to inform their clients in advance

The Law of 20 April 2026 on various economic provisions introduces new information duties towards consumers for fixed‑term contracts longer than one month that include a tacit renewal clause. The law was published in the Belgian Official Gazette on 7 May 2026 and will enter into force one year after that publication.

Article 5 provides that, for any type of fixed‑term contract exceeding one month and subject to tacit renewal, the company must inform the consumer, on a durable medium, of the upcoming automatic renewal of the contract and of the possibility to oppose it.

The legislator’s objective is to strengthen transparency and consumer protection in the context of tacit renewals.

These obligations also apply to insurance contracts, which are concluded between the insurer and the insured. In principle, the duty to inform lies with the insurance company, but depending on organisational or contractual arrangements between insurers and intermediaries, certain administrative tasks related to this communication may be entrusted to the broker.

This development may therefore require increased attention to contract deadlines and may entail additional operational and administrative impacts for some intermediaries.
